Well he is wearing an ATF hat and he is pointing the gun in a much safer direction than the DEA agent was, IMHO.

Actually just because he has an ATF hat doesn't mean he's actually an ATF agent. I'd like to think he's not, but we all know that there's boneheads in every outfit.
