The federal government will not file criminal charges against any of the 15 out-of-state gun dealers accused by Mayor Bloomberg in a federal lawsuit of selling guns illegally, the Daily News has learned.

In a stern rebuke to the city's high-profile crusade against illegal guns, the feds warned the Bloomberg administration that it could face "potential legal liabilities" if it continues to conduct sting operations that fall within the jurisdiction of federal agents.

Bloomberg announced the filing of a federal lawsuit last May against 15 gun dealers, who he lambasted as the "worst of the worst." The city later filed a similar lawsuit against another 12 dealers.

In both cases, the city sent private investigators to gun dealers and secretly videotaped them making what Bloomberg called illegal "straw purchases."

A "straw purchase" refers to when an individual talks with a store clerk about purchasing a gun, but then gets another person to fill out the required federal forms and undergo the mandatory background check.

According to a letter sent to City Hall, the Bureau of Alcohol, Tobacco, Firearms and Explosives and various U.S. attorneys' offices have determined the city's findings against the 15 dealers "do not rise to a level that would support a criminal prosecution."

The letter - sent Tuesday by Michael Battle, director of the executive office for United States Attorneys at the Department of Justice - also scolded City Hall for engaging in sting operations involving persons "without proper law enforcement authority," saying that could put the city in legal jeopardy. Battle added that City Hall could "unintentionally interrupt or jeopardize" criminal probes.

Asked if the Bloomberg administration plans to stop conducting the sting operations, Deputy Mayor Ed Skyler said, "Not necessarily."

"The city hasn't violated any laws," Skyler said defiantly, adding that the city will continue to pursue its civil lawsuits against the gun dealers.

I don't know were to start on this and if I did, the language that I would use would mostly be based on 4 letter words.

Bottom line is that Mayor Bloomberg should be prosecuted, period. If I was to do once, of what he did repeatedly, I know that as a US citizen that I would get my constitutional rights and get a speedy trial. :?

I think the crooked mayor should be charged and prosecuted, at least on some level. If he gets away with what he did on any level, he and others will try to get away with more, just like todays common criminals know they can.

As the article reads, we can pretty well guess that he will get away with it. The clips of "feds warned", "potential legal liabilities", and "could put the city in legal jeopardy" kind of lays it out, he will get away with what he did and if he does it anymore, well, the powers that be may do something, maybe.

Only the law abiding citizen has something to fear these days, and it is from BOTH sides of the law. :x

The mayor should absolutely be charged and prosecuted. By all appearances he conspired to commit a crime before and after the fact. His status does not put him above the law. We do not need more laws. We need to enforce the laws we already have. Standing on trial in a Federal court for his actions my help to curb some of his vitrolic nature.

I honestly doubt the Feds will do anything. After all, Bloomberg is part of the "wealthocracy". Between that and his position as mayor, nothing will be done.

If he sent people in to do straw purchases without a federal investigation, haven't those people broken federal law? Plus, since he organized it, wouldn't he be an accomplice?

Yup.

Bother those who are obgiated to prosecute until you have enough juice to go after them. it is either the bad guy or the guy that fails to prosceute them. Who pays the price? Lay it out in that way and we might get the bad guys, despite the bit of Gov't that protects them

I don't know the specifics of how these stings are being performed... If this falls under the juristiction of the feds, can a local government (or possibly a citizen) claim they are doing this under the color of law?

Isn't it illegal for someone to knowingly attempt a straw purchase?

Sounds like the feds will end up coming down on these fools. If for nothing else than for trying to make the feds look bad.

Yes, it explicitly says so right on the form when buying a handgun.

We don't know whether or not those were actual straw purchases, or merely intended to look like them. Who ended up with the guns that were purchased? If the private detective kept the gun, it wasn't a straw purchase (it doesn't matter who supplied the money). If the gun was turned in to a police department, I think it would be rather difficult to prosecute ("He made a straw purchase of a gun and handed it to the police" is quite different from "He made a straw purchase and handed it to a criminal who couldn't legally buy one.") If the gun was returned, or sold to another licensed dealer by the detective, again, no straw purchase.
