Chief Deputy District Attorney Kent Lovern said the victim acted in self-defense and will not be charged with any crime. But the surviving robber, Damien Cole, 19, has been charged with felony murder for his role in the incident where some died during the commission of another crime. He could get up to 55 years in prison on that charge. Cole also faces charges of armed robbery and attempted armed robbery.

Hmmm... either the guys were idiots and tried to rob someone open carrying, or the victim was illegally carrying concealed.
Good to see no charges being pressed, though.

Now that, folks, is a happy ending.
Yes, I know a robber died. I will waste no tears on him. He made the decision to end his own life when he chose that line of work. The only question was when.
And shooting his partner before dying...that's freaking poetic.

I believe this is a sea change in Milwaukee,
Just a few years ago, a bar owner was jailed for shooting a man who tried to rob him when he crossed the street to deposit the nights receipts in a bank drop. He was told he had NO right to self defense, and that the carrying of the concealed weapon was a felony no matter what..
TO have a DA come right out and say, "nope, No charges, clear case of self defense" is amazing. THis and the Governor's decision not to run for reelection points to a very real chance for a carry permit in Wisc soon.

So the victim was carrying openly? And still got robbed?

I would imagine that the DA found that there wasn't sufficient evidence that he had been carrying in an unlawful manner to charge him with any crime.
Discretion like that is great when it works in our favor **cough**Beard**cough

OC or CC it doesn't matter, the big isue is a wisc DA saying he had a right to self defense outside of his home or business. A far as I can tell, this is the time self defense has been granted as ( or more properly, recognised as) a right.

The Wisconsin Supreme Court has warned that the complete denial of firearms rights is unconstitutional in Wisconsin. To charge him with a firearms violation, when he had an obvious right to use deadly force in self defense, (because he was threatened with deadly force, the robber's gun), would place the prosecution in an awkward position. Especially since the surviving robber needed to be prosecuted and he was also needed as a victim/witness. Ironically, if the robbers had surendered and and he had not had to shoot the one, the prosecution decision may have been to press the gun charge.

Fantastic ending!! One idiot gets what's coming to him, in the process accidently shoots the 2nd idiot and the 2nd idiot gets charged for the death of the first idiot. Absolutely priceless. I wonder if it's bad form to do the 'wave' in a court room?
