Why doesn't the city of Minneapolis consider some type of tenure for police? Oh, wait, it appears they already have it. :bang:

The mother of the teen allegedly kicked by Minneapolis police officer Jason Andersen two years ago is suing the officer, Chief Tim Dolan, the city of Minneapolis and others.

The civil suit calls Andersen a "rogue" officer and comes a month and a half after a federal grand jury indicted him on a criminal charge in the same incident.

In her suit, Stephanie Baxter accuses the officer and the others of assault, battery, false arrest, excessive force and other misdeeds in connection with a 2008 episode in Crystal involving her son, Jevontay K.D. Johnson, then 15.

Baxter, who lives in Michigan, claims the officers' actions "were malicious, unjustified, unreasonable" and were based in part on the officers' "racial animus."

Her son is black. Andersen and the others are white.

The suit accuses Dolan — who has honored but also fired Andersen — of having "a tacit or unwritten policy or custom of failing to properly supervise officers, including certain apparently rogue officers."

The officers claimed Johnson was being disruptive at the annual Crystal Frolics carnival at Becker Park. The incident happened July 25, 2008.

Andersen has pleaded not guilty to the criminal charge, and his attorney, Mark Larsen, has said the officer's use of force was appropriate.

Last year, a federal jury ruled Andersen didn't use excessive force in the 2006 shooting death of Fong Lee, a 19-year-old Hmong man who was shot eight times. Although the Minneapolis city attorney's office defended Andersen in that case, the city has sought outside counsel to represent him and the others in the civil suit. The outside lawyer, Jon Iverson, filed an answer denying that Johnson's rights were violated.

Andersen and two unnamed Minneapolis officers are named as defendants, as are Crystal officers Justin Tourville, Jason Nolan and Todd Gustafson.

The suit alleges Dolan's failures to properly supervise officers "extend to a failure to carry out a rigorous drug-testing program," which "leads to reasonably foreseeable acts of violence and abuse by Minneapolis sworn officers, both on and off duty."

The claim appears to be a reference to one of Andersen's other current legal matters. Dolan fired Andersen last year after the officer was arrested for scuffling with his then-girlfriend, although a prosecutor later dropped the charge.

The Police Officers Federation of Minneapolis filed a grievance, and this spring, an arbitrator ruled the firing was improper. The arbitrator ordered Dolan to reinstate Andersen and pay him back wages.

When the officer returned to work, a supervisor told him he had to take a drug test first. The federation protested, claiming the city was ignoring the labor contract's procedure for drug testing.

A judge sided with the union. The department hasn't brought Andersen back to work, though, and he remains on the city's payroll, listed as being on "home duty."

Andersen has been indicted by a federal grand jury charged with violating the civil rights of a teenage boy by kicking him in the head as Andersen tried to arrest him during the annual Crystal Frolics celebration two years ago. Andersen's attorney says the officer is not guilty and that Andersen feared for his life and worried the boy would grab his gun.

Andersen goes to trial next month, but his attorney tells us the city of Minneapolis did not think Andersen was forthcoming with them about the incident and they fired him.

In a separate case, Andersen was cleared by a federal jury in the shooting death of Fong Lee. Lee's family sued Andersen but lost in court.

This is the second time Andersen has been fired by Minneapolis Police. He challenged his last dismissal and won his job back in arbitration.

In a text message Wednesday afternoon, Andersen told us "Yes we will fight this." Minneapolis police declined to comment. (Personally I believe that there is a liberty issue out there that should take precedence over fighting a termination, but you be the judge.) :lol:

Wow. One high-profile complaint? Disgruntled citizens, perhaps. Two? Coincidence, maybe. As many as this horse's ass has had? Unemployment. I'm amazed at how many times he slides by. Anyone got the odds on if this one sticks? :bang:
