I don't have a clue who is at fault here. Maybe the off duty cop did think he was in imminent danger of having his head caved in. But, it seems that if you pull a gun and the other guy doesn't, you really are screwed. The cops and DA seem to act in favor of the least equipped person.

I can think of one specific case in which a jackass told me he was going to kill me because I told him twice, that I was not going to give him any money and the second time to get the F out of my face. Now that I'm older and maybe wiser, I wouldn't have said that but, what if that happened today and it was the first time I told him I wasn't going to give him any money and he was really big and scary and really wanted to kill me?
I guess I just wish that the police would treat citizens as well as they do their own shooters.

Magnuson, of Knife River, testified he confronted the other man after seeing him driving recklessly. He said he only briefly lifted his gun from his holster when he feared an attack, and he holstered it when the man backed off.

The jury found Magnuson guilty of disorderly conduct and not guilty of second-degree assault, terroristic threats and recklessly handling a weapon.

A 30-day jail term was stayed and he was fined $300.

Magnuson has been on administrative leave and said he looks forward to returning to work.

Strange. It appears that the bulk of what the complainant stated was true. The officer admitted he was confrontational and that he pulled out his weapon from it's holster.

Gee, I'm looking forward to him returning to work also.
