i open carry most of the time, but i want to make sure if i am confronted by an officer that i can make it fact about what happened. i know Minnesota says it is a one party state and my understanding of that is that i am "one" party.

my question here is. can i video/audio record anyone i want (including police) in public? do i have to notify them that i am doing it?

Yes, and no. However, IANAL, and police in particular tend to be unhappy about being recorded by "civilians".

ok im a little confused by the answer. is it a yes for the first half of the question and a no for the other? or is it one of those. yes and no things where its kinda legal and kinda not? hahahaha sorry not to be a disturbance

It is lawful to record as long as one person is aware that the recording is taking place. Doesn't matter if it's you doing the recording, or me. :lol:

Having said that, I would not be surprised if the police try and intmidate you into turning off the recorder, or just take from you for "evidence". I really don't frankly care if you record an encounter with me, as I am most likely recording it too.

If you have a smartphone, get a voice recording app. I have one ready-to-go on open carry excursions with the kids. Start the recorder, and lock the phone... Put it in a shirt pocket, or keep it in your hand.
They won't know it's recording, and they cant find out unless you unlock the phone for them. Which of course you would never do.

no i have not intentions of pissing anyone off. i fully understand that police are only doing their jobs. i am going to school for law enforcement myself and i do a lot of ride alongs in minneapolis. its tough work as it is, let alone some douche trying to make a scene. i just want to make sure there is no... "miscommunication"

Which is why I like the Shirt pocket option... I have tested it setting on the ground, and it's good enough...
