A 17-year-old boy is recovering from a single gun shot to his chest in what police believe was an accidental shooting Friday night at an Austin apartment near the Spam Museum.

Around 9:50 p.m., an Austin officer was at Austin Medical Center when two 17-year-old boys came into the emergency room with the shooting victim, Police Chief Paul Philipp said.

The boy, who could talk when he arrived, was taken to Saint Marys Hospital in Rochester, and his family has listed him as doing "pretty well," according to Philipp, who didn't release any of the boys' names.

The friend who allegedly shot the boy while handling a 9 mm handgun remains in a Rochester juvenile-detention center until an investigation is done, Philipp said. That boy, who helped take the victim to the hospital, had bought the gun at a recent party.

The boys initially told police they were at Todd Park when the victim was shot by someone driving by in a vehicle, Philipp said.

Authorities investigated the scene at Todd Park but found no evidence, Philipp said. There also were too many inconsistencies with the witnesses' stories.

One of the witnesses eventually told police they had been drinking alcohol at Fair Oaks Apartments, 200 11th Ave. N.W., when one of them accidentally shot the boy.

A neighbor to the apartment where the shooting occurred later gave police the bullet that went through the victim and a wall into her apartment, Philipp said.

Police reported finding blood, alcohol and marijuana in the apartment where it happened.

Here we go, the "loop-hole"/ban the sale gang will get up on this one.....

Might be better off banning parties..........makes as much sense. :roll:

If parties were banned, an added bonus would be the elimination of easy access to alcohol by minors... not that I condone such an idea

Teen wounded in gun accident, bullet ends up in neighboring apartment

(KAAL) -- A 17-year old Austin boy remains hospitalized after being shot on Friday night.

The teenager was taken to Austin Medical Center by his friends for treatment of a gunshot to the chest.

His friends told police that they were in a parking lot at Todd Park when another car stopped near them and someone in the car began shooting at them.

Police went to the park, but found no evidence of a shooting.

Police re-questioned the teenagers and one of them admitted that the shooting had taken place at an apartment near downtown Austin.

The boy told police that he and his friends had been handling a nine-millimeter TEC-9 handgun when it accidentally went off.

The bullet struck one of the boys in the chest, exited his back, went through a bathroom wall, and into an adjoining apartment.

No one in the second apartment was injured.

Police have not released condition information about the boy who was shot, but say the boy's family reports that he is in "good condition".

No charges have been filed.



Friday's shooting also nearly resulted in tragedy for another family.

Victoria Harrington says she's scared stiff, but she also says she's very lucky. When an Austin teenager was shot on Friday night, the bullet ended up in her apartment.

"I've never had to deal with a shooting before, let alone have one that comes into my apartment," says Harrington.

Between her son's bedroom and the bathroom is the hole in the wall where a bullet came through from the apartment next door.

"If he would have angled it just a little differently it could have gone into my kids' room."

Victoria Harrington's sons were at home at the time of the shooting-- one was in his bedroom, the other was in the living room playing a video game. No one in the Harrington apartment was injured, but in an instant, life changed

"They can't take nothing out, the garbage out after dark, they have to stay in the house, you know so it is affecting them," says Harrington. "They tell me to stop being overly protective and not to worry, but it's my job."

Victoria Harrington hasn't stopped playing "what if" since Friday night.

"If he would walked past at the wrong time -- my son, you know. And I don't even want to consider what that might have done to my family."

Police say the shooting occurred in an apartment where the 17-year-old shooter lives alone, an apartment rented for him by his mother.

Sounds like a lack of parenting. He's 17 and lives alone in an apartment with alcohol and drugs. Hmmm. :?

Shooting suspect charged with five felonies

A 17-year-old from Austin has been charged with five felonies related to a shooting Friday night.

Nicolas John Nicolazzi has been charged following an incident at a northeast Austin apartment in which another 17-year-old male was allegedly accidentally shot in the chest with a handgun.

The weapon used was a TEC-9 handgun, which is illegal for anyone under age 21 to possess. Nicolazzi allegedly owned the gun and another small caliber pistol with the serial numbers filed off.

According to court documents, charges include: possession of a pistol/assault weapon by someone under age 18; dangerous weapon-discharging a firearm and endangering safety; dangerous weapon-discharging a firearm in a municipality; firearms-receiving or possessing an altered serial number; and 5th degree drug possession.

Nicolazzi had been sent to Many Rivers juvenile facility pending the investigation. The victim had been transported from Austin Medical Center to St. Mary’s in Rochester.

Police Chief Paul Philipp last said the victim’s family stated he is doing well.
